The home sale strategy is deceptive, at best. That notwithstanding, an experienced listing agent will call the lender and find out if there are any contingencies with the loan approval. When it comes out that the loan IS contingent on the sale of the buyers’ home, you’ve now withheld a material fact. Ethics violation. AND the listing agent WILL tell the sellers about the buyers’ attempted deception. You just lost them that house anyway.

The following paragraph requires further explanation... 'There was no possible way for them to make the purchase work without the sale of their home. We knew their home was in a desirable location. We immediately got their home on the market and wrote up an offer to purchase, WITHOUT a home sale contingency!' Unless the home you put on the market before writing the offer to purchase to a seller "who would not accept a contingency that buyer had to sell their existing home first" there had to have been a contingency because the buyer's home hadn't sold yet, therefore.. the offer to purchase was contingent on the buyer's selling their home..
